SİGORTACININ RÜCU HAKKI
- GENEL OLARAK
Sigortacının rücu hakkı, zarar sigortalarında geçerli olan halefiyet ilkesinden kaynaklanır. Halefîyet ilkesine göre sigortacı ödediği tazminat dolayısıyla sigortalının haklarına sahip olur ve üçüncü kişilere karşı doğrudan doğruya dava açabilir (TTK.m.1301; 1361). Bu ilkenin bir sonucu olarak sigortacı, sigorta bedelini ödedikten sonra hukuken sigorta ettiren kişinin yerine geçer, onun halefi olur. Böylece, zarara neden olan kişilere karşı sigorta ettirenin açabileceği tüm davaları sigortacı açar ve meydana gelen zararın tazminine ilişkin talep haklarını kullanır. Ancak, sigortacı, zararın tamamını karşılamamışsa sigortalının ödenmeyen kısma ilişkin talep hakları sona ermez (TTK.m.1301/II). Bu durumda sigortacı, tazmin ettiği zarar ölçüsünde sigortalının halefi olur ve zarardan sorumlu olan kişilere karşı rücu hakkını kullanır.
- RÜCU HAKKINA İLİŞKİN DÜZENLEMELER
- Türk Hukuku’nda
Sigortacının rücu hakkına ilişkin olarak Türk Ticaret Kanunu’nda iki ayrı düzenleme mevcuttur. TTK.m.1301’de kara sigortaları açısından sigortacının rücu hakkı düzenlendiği halde, TTK.m.1361 deniz sigortalarında sigortacının halefiyetini hükme bağlamaktadır. TTK.m.1301’e göre, “sigortacı, sigorta bedelini ödedikten sonra hukuken sigorta ettiren kimse yerine geçer. Sigorta ettiren kimsenin vaki zarardan dolayı üçüncü kişilere karşı dava hakkı varsa bu hak, tazmin ettiği bedel nispetinde sigortacıya intikal eder”. TTK.m.1361’de ise, “Borçlarını yerine getiren sigortacı, sigortalının üçüncü şahsa tazmin ettirebileceği bir zararı tazmin ettiği takdirde, 1256 ve 1258.maddelerin 2. fıkralarının hükümlerine halel gelmeksizin üçüncü şahsa karşı sigortalının haklarına halef olur” şeklinde düzenleme yapılmıştır.
Her iki maddenin kenar başlığı ve metni birbirine benzemekle birlikte, aralarında bazı farklılıklar da mevcuttur. TTK.m.1361, sigortacının “sigorta ettiren”in yerine geçeceğinden bahsederken, TTK.m.1361’de “sigortalı”nın haklarına halef olacağı öngörülmektedir. Bu bakımdan, TTK.m.1361 düzenlemesi daha isabetlidir. Zira, sigortacının tazminat ödeme yükümlülüğü, sigortalıya karşı olduğundan, sigorta ettiren ile sigortalının farklı kişiler olduğu durumlarda, sigortacı, sigortalının yerine geçmekte ve onun haklarını kullanmaktadır. TTK.m.1301’de, sigortacının, sigorta bedelini ödedikten sonra hukuken “sigorta ettiren” kimsenin yerine geçeceği ifade edilmekle birlikte, sigorta ettirenin üçüncü kişiye ait bir menfaati sigorta ettirmesi halinde tazminat sigorta ettirene değil, sigortalıya ödeneceğinden sigorta şirketi de sigortalının haklarına halef olacaktır. Sigorta ettirenin aynı zamanda sigortalı olduğu durumlarda (kendisine ait menfaatleri sigorta ettirdiği hallerde) ise, sigorta tazminatı, sigorta ettirene ödenecek olup, sigortacı da sigorta ettirenin halefi olacaktır.
Türk Ticaret Kanunu’nun bu düzenleme şekli dikkate alındığında, rücu hakkının sigortacının kanuni halefiyetine bağlı olarak kabul edildiği anlaşılmaktadır. Hemen belirtelim ki, rücu hakkına ilişkin kanun hükümleri, TTK.m.1264/II gereğince emredici hüküm niteliği taşır. Bu maddelere aykırı olan sözleşme şartları geçersizdir.
- Alman veİsviçre Hukuklarında
Yabancı ülke hukuklarına bakıldığında, Alman ve İsviçre Hukuklarında sigortacının rücu hakkının Türk Hukuku’nda olduğu gibi zarar sigortaları bakımından tanındığı, ancak bazı yönleriyle daha farklı bir düzenlemeye tabi tutulduğu görülmektedir.
- Alman Hukuku
Alman Hukuku’nda, 01.01.2006’da yürürlüğe giren yeni Sigorta Sözleşmeleri Kanunu’nun (Versicherungsvertragsgesetz) zarar sigortalarına ilişkin 88. paragrafı rücu hakkını şu şekilde düzenlemiştir:
“1. Sigortalının üçüncü kişilere karşı tazminat talep hakkı mevcut olduğu takdirde, bu hak zararı tazmin ettiği ölçüde sigortacıya intikal eder. Bu intikal, sigortalıya karşı ileri sürülemez.
- Sigortalı, tazminat talep hakkını veya bu talep hakkının güvence altına alınmasına olanak veren şekil şartı ve sürelere dikkat etmek ve imkan ölçüsündebu hakka yönelen ihlalleri sigortacıya bildirmekle yükümlüdür. Sigortalı, bu yükümünükasten ihlal ettiği ve bu ihlal sonucunda sigortacının üçüncü kişilerden tazmin hakkı ortadan kalktığı takdirde, sigortacı kendi edimini yerine getirip getirmemekte serbest kalır. Ağır kusurla ihlal durumunda sigortacı, sigortalının kusurunun ağırlık derecesine göre tazminattan indirim yapmaya yetkilidir. Bu durumda, ağır kusurun bulunmadığını ispat yükü sigortalıya aittir.
- Birinci fıkra hükmü, hak sahibiyle aynı aile birliğinde birlikteyaşayan kişilerin verdikleri zararlar bakımından uygulama alanı bulmaz, meğerki bu kişiler kasten zarara sebebiyet vermiş olsun.”
Görüldüğü gibi, Alman Hukuku’nda, Türk Hukuku’ndan farklı olarak, sigortacının rücu hakkı, bütün kişiler açısından tanınmamıştır. Bu kapsamda, sigortalı ile aynı aile birliği içinde yaşayan (in haeuslicher Gemeinschaft) kişilerle ilgili rücu hakkının sigortacıya intikal etmeyeceği kabul edilmiştir. Bu kurala getirilen tek istisna, söz konusu kişilerin zarara kasten sebebiyet vermesidir.
- İsviçre Hukuku
İsviçre Hukukunda ise, sigortacının rücu hakkı, 1908 tarihli Sigorta Sözleşmeleri Kanunu’nun 72.maddesinde düzenlenmiştir. Buna göre,
“1. Üçüncü kişilere karşı haksız fiilden kaynaklanan tazminat talep yetkisi, zararı tazmin ettiği takdirde sigortacıya intikal eder.
- Hak sahipleri, sigortacının bu hakkını daraltacak her türlü davranıştan kaçınmakla yükümlüdürler.
- Birinci fıkra hükmü, hak sahibiyle aynı ailebirliğindeyaşayan ve hafif kusurlu olarak zarara sebebiyet veren kişiler veya fiillerinden hak sahiplerinin sorumluluk taşıdığı kişiler açısından uygulama alanı bulmaz.”
Hemen belirtelim ki, İsviçre Hukuku’nda sigortacının rücu hakkı, sadece haksız fiilden kaynaklanan sorumluluk halleriyle sınırlı tutulmuştur. Ayrıca, Alman Hukuku’na benzer şekilde, İsviçre Hukuku’nda da, sigortalıyla aynı aile birliğinde yaşayan ve hafif kusurlu olarak zarara neden olan kişilerin verdikleri zararlardan dolayı rücu hakkının doğması engellenmiştir. Bunun dışında, sigortalının fiillerinden sorumlu olduğu kişilerin zarar vermiş olmaları halinde de, sigortacı rücu hakkını elde edememektedir. Ancak, Alman Hukuku’ndan farklı olarak, İsviçre Hukuku’nda kasıtlı davranışların yanında ağır kusurla zarar verilmesi hali de rücu hakkının kapsamına alınmıştır. Buna karşılık, sigortalının fiillerinden sorumlu olduğu kişiler de rücu hakkı dışında bırakılarak, Alman Hukuku’na göre daha geniş bir sınırlama öngörülmüştür.
III. RÜCU HAKKININ ESASLARI
Sigortacıya rücu hakkı tanınması iki esasa dayanır. Öncelikle, zarar sigortalarının temelinde yatan zenginleşme yasağının bir sonucu olarak, sigorta ettirenin uğradığı zararı bir kez tazmin etmesi gerekmektedir (tek tazmin fonksiyonu). Bu çerçevede, sigorta şirketinden tazminatı alan sigortalının zarar verene başvuru hakkının da sona ermesi şarttır. Aksi halde, sigortalı, uğradığı zararın tazminini sigortacının dışında bir de zarar verenden talep edebilecektir. Halefiyet kuralı gereğince, sigorta ettiren tazmin edilen zarar miktarı ölçüsünde zarar verene başvuru hakkını kaybetmekte ve bu hak sigorta şirketine intikal etmektedir. Yargıtay kararlarında da bu husus vurgulanarak, sigorta ettirenin bir yandan zarar verenden uğradığı zararı karşılarken, diğer yandan sigorta şirketine başvurarak tazminat almasının sebepsiz zenginleşme niteliği taşıyacağı hükme bağlanmıştır.
İkinci olarak, sigortacı, halefiyet ilkesi sayesinde, zarardan asıl sorumlu olan kişiye başvurarak bu kişinin neden olduğu zararın sonuçlarına katlanmasını sağlayabilmektedir (ceza fonksiyonu). Gerçekten, sigorta teminatı olmasaydı, zarar gören, uğradığı zararın tazmini için haksız fiil hükümlerine göre sorumluluğu bulunan kişilere müracaatla tazminat talebinde bulunacak idi. Sigorta sözleşmesi sayesinde, zarar gören sigortalı bu yükten kurtulmakta ve uğradığı zararı sigortacıdan tazmin etmektedir. İşte halefiyet ilkesi sayesinde, sigortacı, sigortalının yerine geçerek zarar verenden tazminat talebinde bulunmakta ve böylece kusuru ölçüsünde bu kişiye başvurabilmektedir. Hiç kuşkusuz, üçüncü kişinin zarardan sorumlu tutulabilmesi için kusurlu olması ve zararı tazmin yükümlülüğünün doğmuş olması gerekir. Aksi halde, sigortacı, ödediği tazminata bizzat katlanmak zorunda kalacaktır. Nitekim, 17.01.1972 tarih ve 2/1 sayılı Yargıtay İçtihadı Birleştirme Kararında da, “sigortalının ne hakkı varsa bunların sigortacıya geçeceği, sigortacının sigorta ettirenin bütün def’ilerini zarardan sorumlu olana karşı ileri sürebileceği haksız eyleme dayanan rücu davalarında haksız eylem kurallarının uygulanacağı ve sigortacının kanuni halef sıfatıyla bu kurallara göre tazminat isteyeceği, açtığı davanın sigorta ettirenin aynı şahıs aleyhine açabileceği davanın zamanaşımına tabi ve aynı tarihte başlayacağı” öngörülmüştür. Aynı şekilde, Yargıtay 11. HD.nin bir kararında da ifade edildiği üzere, kusuru olmaksızın zarara neden olan bir kişiye karşı sigorta şirketinin rücu davası açması mümkün değildir.
- RÜCU HAKKININ KAZANILMASI
Sigortacının rücu hakkı kanundan doğan bir hak olmakla birlikte, sigortacının sigortalının yerine geçerek zarardan sorumlu olan kişilere rücu edebilmesi için aşağıdaki şartlar aranmaktadır:
- Zarar ınSigorta Teminatı KapsamındaOlması
Sigorta şirketinin rücu hakkının doğabilmesi için, öncelikle, tazminat ödediği kişi ile sigortacı arasında zarar konusunu kapsayan bir sigorta sözleşmesinin mevcut olması ve bu sözleşme kapsamında üçüncü kişiler tarafından zararın gerçekleştirilmiş olması gerekir. Buna göre, zarar gören ile sigortacı arasında tazminat yükümlülüğünü doğuran bir sigorta sözleşmesi yoksa veya zarar konusu olay sigorta teminatı kapsamında değilse ya da zararı doğuran olay üçüncü kişilerce değil de sigortalı tarafından kasten gerçekleştirilmişse, sigortacının tazminat ödeme yükümlülüğü doğmayacağından rücu hakkı da olmayacaktır. Buna rağmen, sigortacının zarar görenlere ödeme yapmış olması halinde, ödediği tazminat için zarar veren kişilere karşı rücu davası açması mümkün değildir.
Sigorta şirketinin rücu hakkının doğabilmesi için aranan ikinci şart, sigortalının zarar veren üçüncü kişiden tazminat isteme hakkının mevcut olmasıdır. Zira, sigortalı, sigorta konusu menfaate zarar veren kişiden tazminat isteme hakkına sahip değilse, sigorta şirketinin de üçüncü kişiden tazminat hakkı olmayacaktır. Bu husus, TTK.m.1301’de “sigorta ettiren kimsenin vaki zarardan dolayı üçüncü şahıslara karşı dava hakkı varsa bu hak, … sigortacıya intikal eder” ifadesiyle öngörülmüştür. Bunun sonucu olarak, sigortalının üçüncü kişiden tazminat isteme hakkının bulunmadığı hallerde, örneğin zarara sigortalı kendi kusuru ile neden olmuşsa, sigorta şirketi sözleşme gereği tazminat ödediği halde üçüncü kişiden tazminat talebinde bulunamayacaktır. Diğer bir deyişle, sigorta şirketine intikal eden hak, sigortalının üçüncü şahıslara karşı olan dava hakkıdır.
Sigortalının dava hakkının hangi hukuki nedenden kaynaklandığı, sigortacının rücu hakkı bakımından önem taşımaz. Buna göre, hakkın kaynağını, trafik kazalarında olduğu gibi bir haksız fiil, bina malikinin sorumluluğunda olduğu gibi kusursuz sorumluluk hali oluşturabilir. İster kanundan isterse haksız fiil, hukuki işlem veya sebepsiz zenginleşmeden kaynaklansın, sigorta teminatı kapsamına giren bir tazminatı ödeyen sigortacı, sigortalının haklarına halef olur ve bu kişinin dava edebileceği tüm kişilere karşı rücu hakkından yararlanır.
Sigorta şirketi, sigortalıya daha fazla tazminat ödemiş olsa bile, kendisine ancak sigortalının uğradığı gerçek zarar karşılığını talep hakkı intikal eder. Bu gerçek zarar karşılığı ödenen tazminat, rücu hakkının üst sınırını teşkil eder ve bu tazminattan fazlası sigortacıya intikal etmez. Sigorta şirketi tarafından tazmin edilmeyen zarar kısmı için, sigortalının zarardan sorumlu olan üçüncü kişiden tazminat isteme hakkı devam etmektedir. Bu açıdan, sigortalı tarafından sigorta şirketine verilen ibraname, sadece ödenen zarar miktarına ilişkin dava haklarının sigorta şirketine intikalini sağlar.
- Sigorta Tazminat ının Ödenmiş Olması
Rücu hakkı, sigorta şirketinin zarar görene ödediği tazminata bağlı olarak sigortacıya tanınan bir haktır. Bu hakkın doğabilmesi için de, sigortacının poliçe kapsamındaki zararı sigortalısına ödemiş olması gerekir. Dolayısıyla, sigorta şirketi, henüz ödeme yapmadan rücu hakkını kazanamaz. Nitekim, Yargıtay kararlarında da, sigortacının rücu hakkını kazanabilmesi için sigortalısına ödemede bulunmuş olması şart koşulmuştur.
Sigortacının rücu hakkı, ödediği tazminat ölçüsünde ve gerçek zarar miktarını aşmamak kaydıyla geçerlilik taşır. Sigorta şirketi, sözleşmede öngörülen muafiyetler çerçevesinde sigortalısına zarar miktarının bir kısmını ödemişse, ödediği tutarın dışında zarar sorumlusuna rücu edemez. Ayrıca, sigortacının gerçek zararı aşan tazminat talepleri de haksız bulunmaktadır. Nitekim, uygulamada, doğru olarak, sigortalının uğradığı gerçek zarar araştırılmakta ve saptanan bu zarara göre mahkemece hüküm kurulmaktadır. Gerçekten, bir çok olayda, sigortalının üçüncü şahsa (fail, istihdam eden, araç sahibi) karşı olan dava hakkı BK. 41 vd. maddelerindeki haksız fiile ilişkin hükümlere dayanmaktadır. Bu gibi hallerde ise, BK. nun 42. maddesi hükmüne göre, mahkeme tarafından ancak gerçek zarara hükmedilebilecektir. O halde, sigortalı üçüncü şahıslara karşı ancak gerçek zararı talep ve dava edebilme hakkına sahip olduğuna göre, TTK.nun 1301/1. maddesi gereğince sigortacıya intikal eden de bu gerçek zararın giderilmesini dava edebilme hakkıdır.
Sigortalıya ödemede bulunan sigortacı, ödeme tarihinden itibaren faiz talebine de hak kazanır. Dolayısıyla, zarar sorumlusunun faiz ödeme yükümlülüğü, rücu davası bakımından olay tarihinden değil, sigorta şirketinin sigortalısına ödeme yaptığı tarihten itibaren başlar, ayrıca bir ihtara gerek yoktur. Buna göre, zarar sorumlusu, sigorta şirketine karşı gerçek zararın dışında faiz ödemekle de yükümlüdür.
Buna karşılık, zarar sorumlusunun sigortacısına karşı açılan rücu davasında faiz talebine hak kazanabilmek için, usulüne uygun şekilde ihtarname çekilmiş olması gerekir; aksi halde, zarar sorumlusunun sigortacısı, dava tarihinde temerrüde düşmüş olacağından faiz de dava tarihinden itibaren işlemeye başlayacaktır.
- Rücu Hakkının Geçerli Olduğu Sigorta Türleri
Halefiyet kuralı, sadece mal ve sorumluluk sigortalarında öngörülmüş olup, can sigortalarında sigortacının rücu hakkı yoktur. Can sigortaları, meblağ sigortası niteliği taşıdığından sigortacı sigortalıya uğradığı zararı değil de poliçede öngörülen belirli bir tutarı ödemektedir. Dolayısıyla, can sigortalarında, sigortalının, sigortacıdan tazminat aldıktan sonra zarar veren üçüncü kişilere de ikinci bir tazminat talep etmesi mümkündür. Gerçekten, ferdi kaza sigortasına ilişkin TTK.m.1338’de de düzenlendiği şekilde, üçüncü kişinin kusuru sonucunda meydana gelen zararlardan dolayı sigorta ettirenin sigortacıdan tazminat alması, sigortalının üçüncü kişiye başvuru hakkını sona erdirmez. Yargıtay 11.HD.nin 07.02.1980 tarih ve E.1979/5047, K.1980/545 sayılı kararında da bu husus vurgulanarak TTK.m.1301 düzenlemesinin mal sigortalarını kapsadığı ve can sigortalarına uygulanmasının mümkün olmadığı hükme bağlanmıştır.
Buna karşılık, hastalık sigortası genel şartlarının 10.maddesinde, sigortacının ödediği tazminat oranında sigortalının haklarına halef olacağı ve zarardan sorumluluğu bulunan üçüncü kişilere başvuru hakkını elde edeceği hükme bağlanmıştır. Dolayısıyla, bir can sigortası türü olduğu halde, hastalık sigortalarında sigortacının sözleşmeden doğan bir rücu hakkının mevcut olduğunu kabul etmek gerekir.
- Rücu Hakkının Kullanılabileceği Kişiler
Sigortacının rücu hakkı, kural olarak, sigorta konusu rizikoyu gerçekleştiren kişiye karşı kullanılır. Ancak, bazı hallerde, zarar verici fiili yapan kişilere karşı rücu hakkının ileri sürülmesi mümkün olmayabilir. Örneğin, zararı doğuran olay, sigortalı veya sigorta ettiren tarafından gerçekleştirilmişse, sigortacının bu kişilere karşı rücu hakkını kullanması söz konusu olamaz. Bu durumda, ancak şartları varsa (örneğin sigorta ettirenin kasdı halinde) sigorta şirketinin tazminatı ödemekten kaçınması gündeme gelir. Bunun gibi, sigorta konusu malı, sigortalının muvafakati ile kullanan kişilerin bu esnada verdikleri zararlardan dolayı da rücu hakkı kullanılamaz. Zira, bu kişiler de tıpkı sigortalı gibidir, sigorta teminatı sigortalının izin verdiği kişileri de kapsar.
Öte yandan, bazı hallerde, sigortacının rücu hakkının zarar veren kişinin (fail) yanı sıra, başka üçüncü kişilere karşı da kullanılması söz konusu olabilir. Örneğin, zarardan sorumlu olan kişi, trafik sigortasında olduğu gibi, bu sorumluluğunu bir sigorta şirketine sigorta ettirmişe veya başkasına ait araçla üçüncü bir kişiye zarar verilmesi durumunda işletenin sorumluluğu ortaya çıkmışsa (KTK.m.50) ya da BK.m.55 gereğince adam çalıştıranın sorumluluğu mevcutsa, rücu hakkının, failin yanı sıra, trafik sigortacısına, işletene ya da adam çalıştırana karşı kullanılması da mümkündür.
- Sigortalının Fiil ve İşlemlerinin Rücu Hakkına Etkisi
Sigorta şirketinin rücu hakkının doğabilmesi için, sigortalıya ödeme yapıldığı anda sigortalının zarardan sorumlu olan üçüncü kişilere karşı dava açma hakkının devam ediyor olması gerekir. Sigortalı, üçüncü kişiye dava açma hakkı bulunduğu halde, daha sonraki hal ve hareketleri ile bu hakkı ihlal edecek olursa, bu durum sigorta şirketinin rücu hakkını da etkiler. Buna göre, sigorta şirketine zararın tazmini için başvuran sigortalı, bu arada zarar veren üçüncü kişiyi ibra edecek olursa sigorta şirketine herhangi bir dava hakkı intikal etmeyecektir. Bu durumda, sigorta şirketinin tazminat ödediği sigortalıya rücu hakkı var mıdır?
Konuya ilişkin TTK.m.1301/II hükmü şu şekildedir: “Sigorta ettiren kimse, 1. fıkra gereğince sigortacıya intikal eden haklarını ihlal edecek bir hal ve harekette bulunursa sigortacıya karşı mesul olur”. Kanaatimizce, TTK.m.1301/II hükmünü değerlendirirken iki hususu birbirinden ayırmak gerekir. Sigortalı, sigortacıya intikal edecek olan hakkı, henüz bu intikal gerçekleşmeden, yani tazminatın ödenmesinden önce ihlal eder ve sigorta ettirenin zarardan sorumlu olan kişilere rücu davası açmasına engel olacak olursa sigortacının yapabileceği bir şey yoktur. Örneğin, zarar veren kişi ile sigortalının anlaşması ve sigortalı tarafından karşı tarafa ibraname verilmesi halinde, sigorta şirketi, sigortalıya ödediği tazminatı zarar veren kişiden bu kişi kusurlu olsa bile talep edemez. Çünkü, sigorta şirketi tarafından tazminat ödenene kadar, zarar verene başvuru hakkı, sigortalıya ait bir hak olup, sigortalı bu hak üzerinde dilediği gibi tasarrufta bulunabilir. Ancak, sigorta sözleşmesiyle sigortalı açısından, sigortacının zarar sorumlularına rücu hakkını engelleyecek davranışlardan kaçınılmasını öngören bir yükümlülük de kabul edilebilir. Taraflar arasında bu tür bir anlaşma olduğu halde, sigorta ettirenin aksine davranışlarda bulunması sözleşmeye aykırı davranış niteliği taşır ve bu kişi BK.m.96 vd. hükümleri çerçevesinde sigorta şirketine tazminat ödemek zorunda kalır. Buna karşılık, sözleşmede hüküm bulunmadığı takdirde, zarar vereni ibra eden sigortalıya karşı sigortacının tazminat talebinde bulunması mümkün değildir. Zira, TTK.m.1301/II’nin ifadesi dikkate alındığında, halefiyetin gerçekleştiği andan önceki hal ve hareketlerden dolayı sorumluluğun doğacağını kabul etmek gerekir. Deniz sigortalarında ise, TTK.m.1361/III düzenlemesiyle, sigortalının tazminat ödenmesinden önceki davranışlarından dolayı da sigortacıya karşı sorumlu olacağı kabul edilmiştir.
Sigortalının tazminatın ödenmesinden sonra yapacağı fiil ve işlemlerle sigortacının halefiyetini engellemesi durumunda ise, ödeme anından itibaren dava hakkı sigorta şirketine intikal edeceğinden sigortalının bu hak üzerinde tasarruf yetkisi bulunmamaktadır. Bu nedenle, tazminatı aldıktan sonra sigortalının, zarar veren üçüncü kişiyi ibra işlemi geçersiz olup, hiçbir hukuki sonuç doğurmaz. Sigortacı, tazminatı ödemekle sigortalının haklarını devralmış olur, bu andan itibaren bu hak üzerinde tasarruf yetkisi sadece sigorta şirketine aittir, sigortalı tarafından yapılan ibra işlemi sigortacının zarar verene başvuru hakkını ortadan kaldırmaz.
Bu noktada, sigortalıya durumu bilmeksizin iyiniyetle ödemede bulunan zarar verenin de korunması gerekir. BK.m.165’e göre, alacağın temlikinden habersiz olarak önceki alacaklıya iyiniyetle ödemede bulunan borçlu sorumluluktan kurtulur. Bu hükmün, sigorta ilişkisinde de geçerli sayılması ve sigorta ilişkisinin varlığından habersiz olarak sigortalıya verdiği zararı karşılayan kişinin iyiniyetle yaptığı bu ödemenin geçerli sayılması mümkündür. Bu durumda, sigortacının rücu hakkının ihlali nedeniyle sigortalıya başvurarak uğradığı zararın tazminini istemesi gerekir (TTK.m.1301/II). Bu çözüm şekli, mal sigortalarında geçerli olan zenginleşme yasağına da uygun düşmekte ve sigortalının bir yandan sigorta şirketinden tazminat alırken, diğer yandan zarar veren kişiden zararını karşılamak suretiyle sebepsiz zenginleşme sağlaması da engellenmiş olmaktadır. Yargıtay 11.HD. 11.05.2000 tarih ve E.2000/2980 K.2000/4071 sayılı kararında da, “sigortalı, 28.11.1997 tarihinde davacı şirketin kasko sigorta tazminatını aldıktan sonra davalıyı ibra etmiş olup, artık dava tarihi itibarıyla davacı sigortacının ödemeye dayanarak dava açma hakkı bulunmamaktadır. Ödediği miktarı, TTK’nun 1301/2.maddesi uyarınca rücu hakkını ihlal eden sigortalısından, açacağı bir dava ile talep etmesi mümkündür” hükmüyle, sigorta tazminatını aldıktan sonra zarar vereni ibra eden sigortalının sigorta şirketine karşı sorumlu olacağı kabul edilmiş bulunmaktadır. Ancak, bu durumda, sigortalıya ödemede bulunan zarar sorumlusunun iyiniyetli olup olmadığına bakmak ve buna göre sigorta şirketinin rücu hakkının sona erip ermediği hususunda bir karar vermek gerekir. Sigortacının rücu hakkının bulunduğunu bildiği veya bilmesi gerektiği halde, sigortalıya ödemede bulunan kişi iyiniyetli sayılamayacağından, sigorta şirketinin bu kişiye karşı dava açma hakkının mevcut olduğunun kabulü gerekir. Buna karşılık, durumdan habersiz olarak iyiniyetle ödemede bulunan üçüncü kişinin bu iyiniyetinin korunması ve sigortacının bu kişiye karşı dava açma hakkının sona erdiğini kabul ederek, sigorta şirketinin ancak sebepsiz zenginleşen sigortalısından TTK.m.1301/II’ye dayalı olarak tazminat isteyebileceği sonucuna varılmalıdır.
- TÜRK TİCARET KANUNU TASARISINDA RÜCU HAKKI
Adalet Bakanlığı tarafından hazırlanan Türk Ticaret Kanunu Tasarısı’nda kara sigortaları-deniz sigortaları ayrımı kaldırılmıştır. Sigorta türleri, zarar sigortaları, sorumluluk sigortaları ve can sigortaları şeklinde üçlü bir tasnife tabi tutulmuştur. Bu kapsamda, rücu hakkı, zarar sigortalarına ilişkin 1450.madde ile sorumluluk sigortalarına ilişkin m.1459’da hükme bağlanmıştır.
Tasarının 1450.maddesine göre;
“(1) Sigortacı, sigorta tazminatını ödedikten sonra hukuken sigortalı yerine geçer. Sigortalının gerçekleşen zarardan dolayı sorumlulara karşı dava hakkı var ise bu hak, tazmin ettiği bedel kadar sigortacıya intikal eder. Sorumlulara karşı bir dava veya takip başlatılmışsa, sigortacı, mahkemenin veya diğer tarafın onayı gerekmeksizin, halefiyet kuralı gereğince, sigortalısına yaptığı ödemeyi ispat ederek, dava veya takibi kaldığı yerden devam ettirebilir.
(2) Sigortalı, birinci fıkra gereğince sigortacıya intikal eden haklarını ihlâl edici şekilde davranırsa, sigortacıya karşı sorumlu olur. Sigortacı zararı kısmen tazmin etmişse, sigortalı kalan kısımdan dolayı sorumlulara karşı haiz olduğu müracaat hakkını muhafaza eder.”
Tasarı hükmü dikkate alındığında rücu hakkına ilişkin olarak mevcut TTK.m.1301’de eleştiri konusu olan “sigorta ettiren” ifadesi yerine “sigortalı” terimine yer verildiği görülmektedir. Ayrıca, uygulamada, rücu hakkının kullanılmasında zamanaşımı süresinin dolması sorunuyla karşılaşıldığından, sigortacıya daha önceden sorumlulara karşı açılan dava veya takibi devam ettirme yetkisi de tanınmaktadır.
Tasarının sorumluluk sigortalarını düzenleyen 1459.maddesinde de sigortacının rücu hakkına yer verilmiştir. Buna göre;
“(1) Sigortacı, sigorta tazminatını ödedikten sonra hukuken sigortalı veya zarar gören yerine geçer. Sigortalının veya zarar görenin gerçekleşen zarardan dolayı sorumlulara karşı dava hakkı var ise bu hak, tazmin ettiği bedel kadar sigortacıya ait olur.
(2) Sorumlulara karşı bir dava veya takip başlatılmışsa, sigortacı mahkemenin veya diğer tarafın onayı gerekmeksizin, halefiyet kuralı gereğince, sigortalısına yaptığı ödemeyi ispat ederek, dava veya takibi kaldığı yerden devam ettirebilir.
(3) Sigortalı veya zarar gören birinci fıkra gereğince sigortacıya geçen haklarını ihlâl edici şekilde davranırsa, sigortacıya karşı sorumlu olur.”
Bu madde ile sorumluluk sigortalarındaki rücu hakkı özel bir düzenlemeye tabi tutulmuştur. Bu konu doktrinde çok fazla tartışmaya neden olmuş ve bu tür sigortalarda sigortalı ile zarardan sorumlu olan aynı kişi olduğundan sigortacının zararın failine (borçluya) başvurması nedeni ile halefiyetinden bahsedilemeyeceği, aksi taktirde sigortacının sigortalısı için ödediği tazminatı geri sigortalısına rücu edeceği şeklinde bir sonuca varılacağı ve bu durumda da sigortalı için prim ödenmesinin bir anlamı olmadığı ileri sürülmüştür. Bu görüşte haklılık payı olmakla birlikte, sorumluluk sigortalarında hiç bir şekilde halefiyetin olamayacağını söylemek de doğru değildir. Şöyle ki, özellikle müteselsil sorumluluk halinde, zarar görenin müteselsil sorumlulardan birinden veya bunun sigortacısından zararının tamamını alması halinde sigortacı sigortalısına halef olarak fazla ödediği miktar için diğer sorumlulara rücu edebilir. Sorumluluk sigortalarındaki halefiyette diğer zarar sigortalarındaki halefiyetten farklı olarak sigortalı yerine zarar gören üçüncü kişiye de halef olunabilir. Zira, üçüncü kişiye halef olunarak diğer sorumlulara karşı rücu yapılabilir. Bu nedenle maddede halefiyetin sigortalı veya zarar gören üçüncü kişi yerine olacağı ifade edilmiştir.
